Welcome to BeenBored.com (“BeenBored”, “we”, “our”), a service operated by UORealms LLC. By accessing or using this website and our instant-play HTML5 games, you agree to these Terms. If you do not agree, please do not use the site.

6) User Submissions

Our total liability is limited to the greater of $10 or the amount you have paid to us (if any) in the past 12 months.

We may suspend or terminate your access at any time if you violate these Terms. You may stop using the site at any time by simply discontinuing access.

9) Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to your use of BeenBored.com shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. Arbitration shall be administered by the American Arbitration Association (AAA) under its applicable rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. Each party shall bear its own attorneys’ fees and costs, except that the arbitrator may award fees and costs to the prevailing party where permitted by law.

The cost of initiating arbitration, including filing fees, shall be borne by the party initiating the claim, subject to the applicable arbitration rules.

10) Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect. An unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the intent of the original provision.

11) Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page, and the “Effective date” above will be updated. Continued use of the site means you accept the updated Terms.

11a) Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles. You and UORealms LLC agree that any dispute or claim not subject to arbitration under Section 9 shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of such courts for all purposes. By using BeenBored.com, you waive any objection to the venue or jurisdiction of those courts.
